Tutor4me - Terms & Conditions

We, Tutor4me, a Singapore-based home tuition service (Company Registration Number: T24LL0339G ). These Terms and Conditions govern your access to and use of the (website) and services provided through the (website), hereafter referred to as “we," "our,", “us”, or "the Company". 

By accessing or using our Service, you agree to comply with and be bound by these Terms and Conditions, which form the agreement between you and the Company.

1. Interpretation and Definitions

Interpretation

The terms used with an initial capital letter in these Terms shall have the meanings defined under the following conditions. These definitions apply regardless of whether the words appear singular or plural.

Definitions

For the purposes of these Terms:

Affiliate: An entity that controls, is controlled by, or is under shared control with another party. "Control" refers to owning 50% or more of the shares, equity interest, or other securities granting authority to vote for election of directors or other management decisions.

Country: Singapore.

Company: This refers to Tutor4me, located in Singapore. It is also referred to as "the Company," "We," "Us," or "Our."

Device: Any device that can access the Service, including but not limited to computers, mobile phones, or digital tablets.

Service: The services offered through the Website, including access to the Website and/or via other means of digital/electronic communications.

Terms and Conditions (Terms): These Terms and Conditions, constitute the entire agreement between You and the Company regarding using the Service.

Third-party Social Media Service: Any third-party service or content, including data, information, products, or services, displayed or made available through the Service.

Website: The online platform, Tutor4me, is available at tutor4me.sg

You (the User): The individual or legal entity accessing or using the Service.

2. Acknowledgment

These Terms and Conditions define the agreement between You and the Company, outlining Your rights and responsibilities when You use the Service.

Your access to and use of the Service depends on your acceptance and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users, and anyone who accesses or uses the Service.

By accessing or using Our Service, You accept and agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you may not access or use the Service.

You agree that to use the Service as a visitor, or registered user, you must be at least 18 years old. If you are below 18 years old, you must have parental permission to accept these Terms and use the Service.

Your access to and use of the Service is also conditioned on your acceptance of and compliance with the Company’s Privacy Policy. Our Privacy Policy explains how we collect, use, and disclose your personal information when you use the Service, as well as your privacy rights and legal protections. Read Our Privacy Policy thoroughly before using Our Service.

3. Changes to These Terms

We may update these Terms and Conditions at any time. Your continued use of the Service after the updates signifies your acceptance of the revised Terms.

4. Use of the Service

Our Service connects students or their parents with tutors for various educational purposes, including but not limited to private home tuition, group tuition, online lessons, and homework help.

All individuals who visit Our site, whether registered or not, are considered "users" of the services provided under these Terms. Once You register by creating an account or requesting a

tutor, You become a "member." There are two types of members: "Clients" (students, parents/ family members, guardians or relatives hiring tutors) and "Tutors" (individuals registered to provide tutoring services).

By using Our Service, both users and members acknowledge and agree that the services offered on our website are the exclusive property of Tutor4me. We may, at Our discretion, introduce new services, update existing ones, or modify the content. Any changes, updates, or additions to the Service will be subject to this agreement unless stated otherwise. Tutor4me reserves the right to modify, suspend, or discontinue any services at any time. 

We will endeavor to conduct basic background checks of tutors. However, it is not always possible to verify. Parents, guardians or students need to assess the tutor’s conduct and experience on the first lesson. Parents, guardians or students may request for a replacement tutor if the tutor is deemed not suitable. 

Eligibility

By using Our Service, you confirm that you are at least 18 years old and have the legal capacity to agree to these Terms. The Service is intended for personal use only. Any use of Our Service for commercial purposes requires prior written consent from Us.

Account Creation

To access specific features of Our Service, you may need to create an account. During the registration process, You must provide accurate, complete, and current information about yourself, such as your name, contact information, age, preferences and address. You agree to update your details if anything changes. 

Tutor4me may use your registration details to provide services, like sharing tuition request, basic tutor profile publicly or sharing contact details between clients and tutors, however, your personal information will remain private.

You are responsible for keeping your account and password secure and must notify Us immediately if you suspect unauthorized access. Tutor4me is not liable for any loss due to failure to comply with these Terms.

Restrictions

You agree not to engage in the following actions when using Our Service:

Violate any applicable law or regulation.

Use the Service for unlawful, harmful, fraudulent, or malicious activities.

Impersonate any person or organization or falsely claim an affiliation with any person or organization.

Interfere with or disrupt the functioning of the Service.

Engage in unauthorized data mining or data scraping.

5. Learner-Tutor Relationship and Key Provisions

Learners can request a replacement tutor or cancel after the first lesson but must still pay for attended lessons.

The tutoring period is typically agreed upon in advance. If not specified, all parties should be prepared to commit for at least three months.

Learners agree to complete at least one lesson with the tutor. If cancelling after one or more lessons, only the attended lessons will be charged, and any remaining fees paid in advance will be refunded. However, if cancelled before the first lesson, learners will incur an administrative fee equal to the first lesson's fee, due by the specified invoice date.

Learners must inform both the tutor and Tutor4me if a lesson needs to be postponed or cancelled. If the cancellation occurs less than two hours before the lesson, learners will be charged 50% of the lesson fee, payable in cash or via bank transfer. This will also cover the tutor's transport costs. Cancellations or changes will not affect Our commission.

The tuition schedule, including the date and time of the first lesson, must be confirmed and adhered to. Learners may renegotiate the schedule with the tutor, but any changes to lesson frequency within the first four weeks or until the agency commission is paid, must be communicated to Tutor4me. We may adjust commissions based on these changes. 

Clients shall conduct verification checks on tutors on the first lesson. Tutors are obliged to provide the necessary information for such checks. 

6. Termination

We reserve the right to suspend or terminate your access to the Service, with or without notice, for any reason, including violations of these Terms.

Termination may include:

Removal of access to all or part of the service

Deletion of your password and account information

Blocking further use of the website

7. Payment Policy

All payments are in Singapore dollars (SGD). You are responsible for any taxes, levies, or duties related to payments made through Our services.

Tuition rates listed on our platform are guidelines. The final price may vary based on factors such as client requirements, market conditions, and tutor availability. Tutors set their rates, but the agreed price must be confirmed through an official invoice from Tutor4me.

Learners must pay invoices within three days of the due date and keep a bank receipt as proof of payment. If payment is not received within 14 days, We may send reminder letters or refer the account to lawyers for further action. Learners or tutors are responsible for any costs associated with the recovery of overdue payments.

The agreed tuition rate should not change unless mutually agreed by both parties. Tutor4me reserves the right to claim commission based on the original rate.

Generally, We collect tuition fees from learners and resolve any payment issues with the tutor. If learners avoid Tutor4me and pay tutors directly, they are liable for the agency's commission and any associated fees.

Tutors should not collect commissions directly from learners. If they do, they must inform Tutor4me and make the payment within three days. Failure to comply may result in additional fees.

Learners are responsible for paying tuition fees for all attended lessons, regardless of lesson satisfaction. Refunds may be issued if the tutor is at fault, and learners may be charged for unpaid obligations.

If there are disputes over tuition fees, We will assist where possible, but We are not legally responsible for any payment conflicts. Learners must notify the Company and tutor of any lesson changes. If a lesson is cancelled or postponed by learners within two hours of the start time, the learners are liable for 50% of the lesson fee, payable immediately. Cancellations do not affect Tutor4me's commission.

Clients are bound to pay the Tutor4me agency fees. Legal action will be taken against Clients and Tutors who collude to avoid paying agency fees. Any legal costs incurred shall be recovered from the Clients. 

8. Links to Third-Party Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by Us. 

We have no control over and are not responsible for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that the Company is not responsible or liable, directly or indirectly, for any damage or loss caused by or in connection

with the use of or reliance on any content, goods, or services available through those third-party websites or services. 

We strongly recommend that you review the terms and conditions and privacy policies of any third-party websites or services you visit.

9. Limitation of Liability

Tutor4me is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or business interruptions, even if advised of the possibility of such damages.

While We strive to provide accurate and up-to-date information on Our platform, much of the content is user-submitted, and We cannot guarantee its accuracy, including tutor qualifications or Service details. The content may change without notice, and We are not liable for any outdated or incorrect information.

Although We take reasonable measures to keep Our platform secure and free from viruses or harmful code, We cannot guarantee complete security. Users are responsible for their own security measures.

10. Intellectual Property 

All intellectual property on this Website, including images, logos, text, graphics, and software, is owned by Tutor4me and protected by copyright laws. You are granted access only to use the materials for personal purposes.

You agree not to use the Website for illegal purposes or in any way that could harm or overload the Website. You cannot attempt to access content through unauthorized methods.

You may not modify, publish, distribute, reverse engineer, or sell any of the Website’s content. 

Protected content is for personal use only and cannot be shared without written permission from Tutor4me or the copyright owner. You do not gain ownership rights to any protected content, and We do not grant any licenses to Our intellectual property, except as allowed by these Terms.

11. Restrictions and Obligations

Some areas of Our Service may be restricted, and access can be limited at Our discretion. You are responsible for keeping your user ID and password confidential.

You agree to comply with all relevant laws and regulations when using Our service and ensure You do not disrupt the experience for other users or interfere with the Website’s operation.

When providing information to Our service, ensure it is accurate, authorized, complete, and truthful. This applies to registration details, documents, photos, or any other materials You submit. If You provide false or incomplete information or fail to meet membership criteria, We reserve the right to suspend or terminate your access.

You agree not to impersonate others or engage in harmful activities while using Our Service.

Tutor4me may refuse Service to learners or tutors without explanation. Access to Our Website is prohibited in areas where the Service or content is illegal, and You are responsible for complying with local laws.

12. Website Use and Conduct

Our Service is for personal, non-commercial use only. You agree not to use it for any of the following prohibited actions:

Posting or distributing content that violates intellectual property rights or is unlawful, abusive, defamatory, obscene, or offensive.

Engaging in commercial activities (like advertising or pyramid schemes) without Our written consent.

Impersonating others or misrepresenting your identity, including staff or representatives of Our Service.

Taking actions that overload the website or disrupt its proper functioning.

Attempting to ignore security or reverse-engineer the website.

Tutor4me reserves the right to remove any content at any time for any reason. You must respect all copyright and ownership notices. Unauthorized use of content such as copying, distributing, or modifying is prohibited unless specifically allowed.

Deleting your account will remove all associated data.

13. Communication Policy

Our site may include chat areas, forums, news groups, pages, and other communication services for public or group interactions. You agree to use these services to post appropriate, lawful, and relevant material. Specifically, you agree not to:

Harass, defame, or violate others' legal rights.

Post inappropriate or illegal content, including material protected by intellectual property laws.

Advertise or sell goods/services for business purposes without Our consent.

Tutor4me is not obligated to monitor these services and does not endorse any content posted. We reserve the right to review and remove content and suspend your access to communication services at any time for any reason.

14. Governing Law

These Terms shall be governed by and construed following the laws of the Republic of Singapore, without regard to its conflict of laws principles. Any dispute arising from or related to these Terms shall be resolved in the courts of the Republic of Singapore.

15. Dispute Resolution

If You have any disputes or concerns regarding the Service, You agree to first try to resolve the issue informally by contacting Us. If the dispute cannot be resolved informally, You agree to resolve the dispute bound by laws of the Republic of Singapore. 


16. Severability and Waiver

Severability 

If any part of these Terms is found to be unenforceable or invalid, it will be revised to reflect the original intent as closely as possible under applicable law. The rest of the Terms will remain in full effect.

Waiver

Except as provided herein, the failure to exercise a right or to require the performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time. Additionally, waiving one breach does not waive any future breaches.

17. Translation and Interpretation

These Terms may have been translated into other languages. In case of any dispute, the original English version will prevail.
